TERMS & CONDITIONS
These Terms and Conditions apply to all transactions between us and you. They do not affect your statutory rights. Please read them carefully.
We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website.
These Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.
Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions.
We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
To order goods over the telephone or on our website, you must be at least 18 years of age and accept delivery within the UK. All telephone orders will be acknowledged verbally at the time of order, and all orders placed on our website will be acknowledged electronically by e-mail. Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in-person or by telephone or e-mail).
When deciding whether or not to accept your order we may use certain information about you to protect you and us against fraudulent transactions.
We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest that you (re-)visit our store.
The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged.
We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time the order is placed.
Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative or suggest that you (re-)visit our store.
On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from that in-store.
Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
Prices that are reduced for sales and promotions are only valid for the specified period.
Your order is sent directly to our secure till in our shop for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We aim to dispatch all orders within 24 hours of receipt.
You can track the progress of your order at any time by logging into My Account from the Home page on this website.
All deliveries are subject to stock availability and authorisation of your payment. In the event of any stock or payment issues we will contact you by email or phone to discuss.
We can either deliver your order to an address of your choice or you can collect in-store.
Standard and Next day deliveries are normally made Monday-Friday from 9am-6.00pm (excluding Bank Holidays).
Same Day deliveries are made between 1.00pm and 6.00 pm Monday to Friday and between 1.00pm and 5.00pm on Saturdays. Same Day delivery is not available on Sundays or Bank Holidays.
In the unlikely event that you receive the wrong order, please contact us as soon as possible so we can arrange for the item(s) to be collected and the correct one(s) to be dispatched to you.
If you have any questions about the delivery of your order, please call us in-store on 01702 582555. Lines are open Monday to Saturday 8.30am to 5.30pm and Sunday 10.00am to 2.00pm (excluding all Bank & Public Holidays).
For items ordered for collection at store, there is no delivery charge. It will be held at the store for seven working days for your collection. After this time, the goods will cease to be reserved for you and will return to general store stock.
Please note that Next Day is a proof-of-delivery service, and requires a signature on delivery.
Standard delivery Standard delivery is subject to charge of £12 on all orders. Your order will be dispatched within 24 hours and will take up to 5 days to reach you.
Same Day delivery is subject to £10 charge Same day delivery is available on orders over £50. Orders must be received no later than 1.00pm. Same day delivery is only available in post codes SS0 SS1 SS2 SS3 and SS9.
Next Day Delivery The next day delivery service applies on orders placed before 12pm Monday - Thursday. Orders placed on Friday, Saturday & Sunday will be delivered on Monday. If the service is not available in your area it will not be shown as and option once you have selected your delivery address. Delivery times cannot be guaranteed.
For Standard and next day deliveries orders placed after 12pm on Friday, the next available delivery date will be the following Monday.
We hope you will be happy with your purchase however any unwanted items must be sent back at your expense in original packaging and condition to:

We suggest for your own protection you use 1st class registered post.
Any refunds will be issued once we have received the goods, in their original condition within 7 days of original delivery. This refund is limited to the cost of goods sent and not the delivery charge. However, if the goods are faulty or are being returned due to our error we will refund the postage incurred in returning the items.
We will not charge a restocking fee for returned items.
WE ARE UNABLE TO TAKE RETURNS ON PAINTS MIXED TO ORDER. THIS INCLUDES ALL LITTLE GREENE, SANDERSON, PAINT LIBRARY, AND DESIGNERS GUILD paints, unless faulty.
This does not affect your statutory rights.
If the purchase was made by credit card, any refunds will only be made to the card originally used to make the purchase.
Gardner's Leigh on Sea is committed to protecting your privacy. We will only use information given at the time of ordering or when making an enquiry by whatever means is collected lawfully and in accordance with the Data Protection Act 1998.
With the exception of debit & Credit card processing, we do not pass your personal information on to third parties.
All transactions that you initiate with Gardner's Thorpe Bay on this web site are confidential. Your name will not be added to any third party mailing lists.
The Data Protection Act
Under the terms of the Data Protection Act 1998, we have a duty to protect any information we collect from you. It will not be disclosed to any other organisation unless you give explicit permission, or there is a legal obligation to do so. We collect information about you for two main reasons:
- To process your online order.
- To provide you with the most efficient possible service.
The information collected will be used to personally keep in touch and let you know of any offers, sales or promotions that Gardner's Thorpe Bay are carrying out (if you have selected to receive these emails/newsletters).
Right to request information

Changes to this policy
These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
